Conditions of Approval

1. The Conditional Use Permit (CUP) is for a dog breeding and boarding kennel operation, changes to the use are not permitted without approval of a new/amended permit.

2. The operation and site shall comply will all Federal, State and Local rules and regulations. Site owner and operator shall maintain proof of compliance with applicable regulations and submit said proof to county staff upon request.

3. Indoor facilities having adequate heating, ventilation, and lighting shall be provided for all animals. Outdoor facilities shall have shelter from the elements, sunlight, rain, snow, and cold weather.

4. Facilities shall be inspected at least once a year at the owner’s expense by a doctor of veterinary medicine who shall provide a report to the County, by August 1st of each year, describing the condition of the animals and facility, medical treatment required by the animals, and remedial actions necessary to improve the condition of the facility.

5. Proof of a proper animal waste disposal system shall be submitted annually, by August 1st of each year, to the Rice County Environmental Services office.

6. There shall be no more than a total of thirty adult (over 6 months of age) dogs and up to 30 puppies (being under 6 months) on the site at any one time.

7. The approved site plan shall be followed. Animals shall only be housed within existing structures as identified on the approved site plan.

8. All buildings used shall meet building code for the intended use. Any new construction on the parcel is to adhere to all Rice County codes and ordinances.

9. Failure to comply with conditions may result in revocation of the conditional use permit

Zoning Administrator Trent McCorkell (TM) presented the request to the Planning Commission (PC).

PB - Is there any recommendations on condition #6?

TM - typically the recommendation would be tied to what the applicant is proposing.

The PC asked the applicant, Randy Voracek (RV), to come forward to add comments or answer questions regarding the request.

RV - I have been raising german shepherds for 30 years. I have a kennel license with the state. The state inspections have had good results with no problems, dogs in good shape and healthy, nice family dogs and not aggressive.

TS- what is the number of dogs you are requesting?.

RV - I now have a total of 25 adult dogs, different ages, some older with no pups at this time. Let's set it up for 30.

PB - is that total dogs with pups, what is your threshold?

RV - the most I have had is 25 to 30 pups at one time that would be the maximum. Normally what I have is 1 litter of 8 to 10 pups at a time.

TS - do you need to specify amount or grand total?

TM - may want to split by age, have done both either a total amount or so many adults with so many younger.

TS - What is your preference?

MS - I would suggest 30 adults and 30 pups under 6 months.

RV - I would agree to that.

CP- this request was brought up at township meeting and there are no issues.

TS - he has been doing this all his life.

Motion to recommend approval with stated conditions as discussed and findings made, seconded, and approved.
